Data Protection Notice to Job Applicants
1. What is this document?
As part of your application to work with Balfour Beatty Management you will be providing us with personal information about you. We give you this notice so that you understand why we need that data and what we will do with it. If you have any queries about this notice, you should contact our Data Protection Officer whose contact details are set out at the end of this notice.
Under the Data Protection Act 1998 (the “DPA”), Balfour Beatty Management and Z170156X of the data controller registration is the data controller of any personal data relating to you that we hold.
Personal data is defined by the DPA as data that relates to a living individual who can be identified from those data, or from those data and other information which is in the possession of, or likely to come into the possession of, the data controller and includes any expression of opinion about the individual, and any indication of the intentions of the data controller or any other person in respect of the individual. Personal data will therefore cover basic information about you such as your name, address, telephone number, and date of birth that may be included on your CV.
Personal data also includes “sensitive personal data” Sensitive personal data is defined as data about your racial or ethnic origin, religious or other beliefs of a similar nature, physical or mental health or condition, sexual life and offences (including alleged offences) and proceedings.
2. Why do we ask you to provide us with your personal data and what will we do with it?
We collect your personal data so that we can progress your application to work with us. We will use the information provided to us to help us assess your suitability for the role or any other role that we have open.
We may also ask you to provide to us during the application process sensitive personal data personal where that information is necessary to assess your suitability for the particular role in question. For example, your offer of employment may be conditional upon you completing a medical and health questionnaire so that we can assess whether you are physically able to perform the role in question. Where we need to do this, we will ask you to give your express consent before we collect that data about you.
We will not use your personal data or sensitive personal for any other purpose other than as described above and we will process (that means collect, store and use) the information you provide in a manner that is compatible with the DPA.
3. Who can see your personal data?
We will disclose your personal data only to those of our employees who have a strict need to see it in order to progress your application and in the event that you are successful in obtaining employment with us, to organise your employment with us.
We may provide your information to other companies in our group if we believe that your skills better match their needs than ours. If you do not wish us to do this, you should indicate this to [insert name of OpCo DPO] whose contact details are below as soon as possible.
Should we offer you employment, we will need to provide your details to third parties to confirm the accuracy of certain information provided to us by you and we will also need to contact your nominated referees to check your references. We will make it clear in any offer of employment we make you where we need to do any of these checks and what we will ask them. We only use reputable companies that understand and comply with their requirements under the DPA to provide this service to us and we will not contact any of your referees unless you have first consented to us doing so.
4. How do we safeguard your personal data?
We treat all the personal data that we hold with care and security. Any details you give will remain completely confidential. The information you provide will be subject to procedures to make sure it can't be seen, accessed or disclosed to anyone who shouldn't see it.
If you are unsuccessful in your application for work with us, we will keep your application on file for up to 6 months in case a role becomes available whether with us or a company in our group that we consider might match your skills. After that time, we will not retain personal information relating to you.
In the event that you are successful in your application with us, your personal data (and any sensitive personal data relevant to your employment that you have provided to us) will be transferred to your permanent employment file with us and we will use it in the way described in your employment contract or in our privacy policy. We will endeavour to keep your information accurate and up to date and not keep it for longer than is necessary.
